Terms & Conditions

A & A Pest Control

1. Agreement

A & A Pest Control (“AAPC”) agrees to provide pest inspection and/or treatment services (the “Service”) for the premises described in the customer’s booking confirmation.
These Services are limited to the areas and pests specified in this agreement. Furniture, fixtures, and equipment are excluded unless expressly stated in writing. Additional pests or areas will require a separate quote and agreement.

2. Acceptance of Terms

By engaging A & A Pest Control to carry out any Service, the Customer is deemed to have read, understood, and accepted these Terms and Conditions in full.

3. Fees and Payment

3.1 All fees are payable to AAPC as agreed. Fees are exclusive of GST unless otherwise stated.
3.2 Payment is due on the day the Service is carried out or 7 days from the date of the invoice.
3.3 AAPC will issue an electronic invoice on the Service date. Credit/debit card charges, where authorised, will be processed on the same day.
3.4 Cancellations made with less than 24 hours’ notice, or if the Customer fails to provide access to the premises at the scheduled appointment time (no-show), will incur a cancellation fee of $99.00 plus GST.
3.5 Overdue accounts may be referred to a debt collection agency. The Customer is responsible for all collection costs, including legal and administrative fees.

3.6 Additional charges apply for any work requested or required to be carried out before 9:00am or after 5:00pm.
3.7 Public holiday rates and after-hours charges apply where Services are booked or performed on public holidays or outside standard business hours.

4. Overdue Accounts and Deductions

4.1 Interest may be charged on overdue invoices at 2% above AAPC’s bank overdraft rate, calculated daily.
4.2 The Customer must not withhold or deduct any payment due to AAPC by way of set-off, counterclaim, or otherwise.

5. Service Performance and Effectiveness

5.1 AAPC will perform all Services in a professional and competent manner. The long-term effectiveness of pest control depends on the Customer following AAPC’s advice on hygiene, housekeeping, and maintenance.
5.2 Effectiveness may be reduced if treated areas are disturbed, cleaned, renovated, or if infested items are reintroduced to the property.

6. Inspection and Treatment Conditions

6.1 Inspections are visual only and limited to areas accessible at the time of inspection.
6.2 Furniture, fixtures, and stored goods may conceal pest activity not visible during inspection.
6.3 Only the pests and areas specified in the agreement are included. Additional pests or areas must be agreed upon separately in writing.

7. Recommendations and Follow-Up

7.1 AAPC technicians will provide a Service Report and offer recommendations to help prevent future infestations.
7.2 AAPC reserves the right to discontinue Services if the Customer does not follow essential recommendations for pest management.

8. Access and Safety

8.1 AAPC complies with all obligations under the Health and Safety at Work Act 2015. The Customer must provide a safe and suitable environment for our technicians.
8.2 Access to facilities such as water and electricity must be available during Service.
8.3 Before treatment begins, the Customer must inform AAPC of any known safety hazards, including asbestos, infectious diseases, or chemical sensitivities.

9. Utilities and Structural Damage

9.1 If the Service involves drilling or cutting, the Customer must identify all service lines (water, gas, electrical, drainage, etc.) prior to commencement.
9.2 AAPC will take reasonable care but accepts no liability for damage to hidden utilities unless caused by our negligence.

10. Indemnity

The Customer agrees to indemnify AAPC and its employees from any claims, losses, or costs arising from:
• Misuse of pest control equipment by the Customer or their representatives; or
• Reliance on inspection reports or recommendations by third parties not authorised by AAPC.

11. Force Majeure

AAPC will not be liable for any delay or failure to perform its obligations due to circumstances beyond its reasonable control, including but not limited to natural disasters, government restrictions, pandemics, or equipment failure.

12. Privacy and Credit Information

12.1 AAPC collects and uses personal information in accordance with the Privacy Act 2020.
12.2 Where credit terms are provided, AAPC may obtain and disclose credit-related information as permitted by applicable law.

12.3 By requesting a quote or requesting AAPC to contact the Customer, the Customer agrees to opt-in to receive emails and promotional material from A & A Pest Control. If the Customer no longer wishes to receive such communications, they may opt out at any time by emailing AAPC.

13. Consumer Guarantees Act 1993

13.1 If the Customer acquires Services for personal, domestic, or household use, the Consumer Guarantees Act 1993 (CGA) applies.
13.2 Nothing in these Terms limits or excludes any rights under the CGA.
13.3 If the Services are acquired for business purposes, the CGA will not apply.

14. Limitation of Liability

To the maximum extent permitted by law:
• AAPC will not be liable for indirect or consequential losses.
• For CGA-related claims, liability is limited to re-supplying the Service.
AAPC’s total liability under this agreement will not exceed the total amount paid by the Customer for the Service.

15. General Provisions Terms & Conditions

15.1 Any amendments to these Terms must be in writing and signed by both parties.
15.2 If any part of these Terms is found invalid, the remainder will continue in effect.
15.3 The Customer may not assign or transfer any rights under this agreement without AAPC’s written consent.
15.4 These Terms are governed by the laws of New Zealand, and both parties submit to the jurisdiction of the New Zealand courts.
